Children banned from talking about fracking.
« on: August 29, 2013, 04:54:50 pm »
http://www.motherjones.com/blue-marble/2013/08/7-year-old-kid-fracking-gag-order

Quote
When a property owner reaches a settlement with an oil or gas driller, it's not unusual for the company to demand that the plaintiffs in the case agree to a gag order that bars them from talking about the agreement. But a recent case in Pennsylvania is unusual. That's because the gag order prohibited the 7- and 10-year-old children of a couple that sued several gas companies not only from talking about their specific settlement, but from mentioning fracking at all. Ever.

Chris and Stephanie Hallowich reached a $750,000 settlement with Range Resources Corporation, Williams Gas/Laurel Mountain Midstream, and Markwest Energy related to health and environmental impacts they say they suffered due to natural gas development operations near their farm in Mount Pleasant, Pa. The family used the money to relocate. But in exchange, they had to agree that they could not comment "in any fashion whatsoever about Marcellus Shale/fracking activities."

http://www.rawstory.com/rs/2013/08/04/fracking-settlement-puts-permanent-gag-order-on-7-year-old-and-10-year-old/

Quote
A transcript of one of the hearings leading up to the settlement revealed that the family’s lawyer, Peter Villari, attempted to make certain the family knew what they were agreeing to:

Mr. Villari: You both understand and accept that as written the settlement agreement may apply to your children’s First Amendment rights as well?

    Mrs. Hallowish: Yes.

    […]

Mr. Villari: And you accept that because you, as adults and as legal guardians and parents of these children, are accepting these terms and conditions because you believe it is in the bet interests of not only them but your family?

Mr. Hallowich: Yes, and health reasons. We needed to do this in order to get them out of this situation.

Later in the same hearing, attorney James Swetz, representing Range Resources, asserted that the ban should extend to the Hallowich family children, a 10-year-old son and a 7-year-old daughter.

“I guess our position is it does apply to the whole family,” Swetz said. “We would certainly enforce it.”

So please explain to me how private property laws are better than government regulation?
I'd be more sympathetic if people here didn't act like they knew what they were saying when they were saying something very much wrong.

The parents. The settlement money can be yanked away from the family if the company feels the need to gag order the children too and the children talk.

What if the kids start talking about Battlestar Galactica?

Anyway, I'd like to tell the oil-jerks, from the bottom of my heart.....FRAK You!

(I confess I only very vaguely know the old version of the show with Lorne Greene, Dirk Benedict & that kid with that fuzzy alien dog thing. I know less about the newer one except 'Starbuck's a woman' & 'darker & edgier with shades of grey'.)

They are also forbidden to even think about a white elephant.
I am an old man, and I've seen many problems, most of which never happened.

Or a blue antelope.
Mockery of ideas you don't comprehend or understand is the surest mark of unintelligence.

Even the worst union is better than the best Walmart.

If I were one of the kids, I'd speak out about fraking purely to act against the Gag Order.

Those are purely disgusting legal drivels.

So what will happen when the children get to legal age? Would they still be bound by a contract that their parents made? This whole thing is not only insidious but pretty damn ingenious in that they know that children will speak and if/when they do then all they have to do is swoop in and take that family's money away.

Children that young shouldn't be speaking about frakking anyway!
