Cool for 'Bama. I bet Georgia will be the last state to legalize gay marriage simply to be known for something other than being "That state Atlanta's in." Whether it's for good or ill. :p

Something about that wording rubs me the wrong way -- probably the fact that no jurisdiction in the world recognized gay marriage at the beginning of the 21st century.

As I've noted before, the first jurisdiction in the world in which gay marriage became legal was the Netherlands, where the law came into effect on April 1, 2001. (The law had, however, been passed and signed by the Queen before 2001.) So, yeah, I too dislike equating "enters the 21st century" with "legalizing gay marriage", especially when it's done via a judicial ruling.

I think you are spot on about Georgia lawmakers being utterly spiteful, SpaceProg. I see parallels between Atlanta and Austin, Texas. Both cities are Red State capitals, and both cities are deep blue and relatively progressive compared to the states they are in. The Georgia General Assembly fuck wits love the fact that they pass outrage after outrage in law and policy from deep within "enemy" territory, a city that has long been called the "San Francisco of the South".

Alabama Chief Justice Roy Moore, in an 11th hour move to keep the weddings on hold, sent an order to state probate judges Sunday night telling them to refuse to issue the marriage licenses to gay couples. Moore argued that judges are not bound by the ruling of a federal judge that the gay marriage ban is unconstitutional.
It was a dramatic return to defiance for Moore who was removed as chief justice in 2003 for refusing to obey a federal court order to remove a washing machine-sized Ten Commandments from the state judicial building. Critics lashed out that Moore had no authority to tell county probate judges to enforce a law that a federal judge already ruled unconstitutional.

Moore said Granade had no authority to order the change and that Alabama courts could do as their judges saw fit until the U.S. Supreme Court ruled. Last week, Moore sent a letter urging probate judges to reject the licenses. The head of the judges' association on Friday predicted most would issue the licenses. Moore upped the ante Sunday night by sending the directive.
"Effective immediately, no probate judge of the state of Alabama nor any agent or employee of any Alabama probate judge shall issue or recognize a marriage license that is inconsistent with [the Alabama Constitution]," Moore, who serves as head of the court system, wrote in the letter sent Sunday night.

Moore has been one of the state's most outspoken critics of gay marriage. He called homosexuality an "inherent evil" in a 2002 custody ruling against a lesbian mother.
Hey guess what asshole issuing marriage licences to same-sex couples wouldn't be inconsistent with the Alabama Constitution since that bigoted bit of it about marriage isn't in effect any more.

Feb 9 (Reuters) - The U.S. Supreme Court on Monday refused a request by Alabama's attorney general to keep same-sex marriages in the state on hold until the court decides whether laws banning them are constitutional.
The court said it would not issue a stay on a federal judge's ruling last month that struck down Alabama's ban on weddings between couples of the same sex.
