For it to make gay marriage legal, the Supreme Court would have to not just uphold, but expand the original ruling. The ruling does not hold in places where gay marriage was never legal. Only where it was made legal and then banned, thereby denying a minority group an existing right. It does not apply if they never had the right to begin with.
